The legal aspects of the cybersecurity system are regulated by dedicated EU Directives and national regulations. One of the most important documents is the NIS2 Directive, which replaces the previous NIS Directive.
October 18, 2024, marks the deadline for implementing this directive into Polish national law under the National Cybersecurity System Act. The National Cybersecurity System applies to selected entities, including key service operators (OUK), digital service providers (DUC), and public entities. Companies identified as “Key Service Operators” have 3 to 12 months to comply with the requirements outlined in the regulation.
Key entities include energy, transport, banking, financial market infrastructure, healthcare, drinking water, wastewater, digital infrastructure, OCT service management, public administration, and space sector.
Important entities include postal and courier services, waste management, manufacturing, chemical production and distribution, food production/processing and distribution, digital service providers, and scientific research.
Companies classified as “key entities” have received or are receiving administrative decisions under the currently applicable NIS/KSC framework. They are required to fulfill obligations under the UKSC.
For NIS2, “important entities” will not receive administrative decisions, which does not exempt them from implementing, documenting, and demonstrating compliance. The “Size Cap” principle applies: NIS2 covers all entities qualifying as medium-sized enterprises that operate in the sectors specified in the directive. Exempted are SME enterprises (micro, small, and medium-sized) with fewer than 250 employees, annual turnover below 50 million EUR, or an annual balance sheet total not exceeding 43 million EUR.
